Terms and conditions



Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between SAS MIA CAMBRO, operating Clos Ceres, and any individual or legal entity booking a stay in a bed and breakfast or gîte.
All bookings imply full and unreserved acceptance of these GTC.

Article 2 – Booking and Contract Formation
A stay at Clos Ceres can be booked online, by telephone, or by any other means offered by the establishment.
A booking is considered firm and final only after:
- validation by the establishment,
- and provision by the client of a valid credit card imprint, used as a guarantee.
No deposit is required.
The establishment reserves the right to:
- refuse any reservation in the event of insufficient or invalid guarantee,
- cancel a reservation if pre-authorization of the bank card is not possible.
Providing bank details constitutes:
- full and complete acceptance of these General Terms and Conditions of Sale,
- authorization to debit the property in the cases provided for herein (including late cancellation, no-show, or damages).

Article 3 – Prices

Prices are expressed in euros (€), inclusive of all taxes (VAT included), excluding tourist tax.
The applicable rates are those in effect on the day of the reservation.
The establishment reserves the right to modify its prices at any time without retroactive effect on confirmed reservations.

Article 4 – No Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, accommodation services provided on a specific date are not subject to the right of withdrawal.

Article 5 – Payment Terms
Payment may be made by any means accepted by the establishment.
The balance of the stay is due no later than check-out, or according to the conditions specified at the time of booking.
In the event of non-payment, the establishment reserves the right to refuse access to the premises without compensation.

Article 6 – Cancellation and Modification by the Client
All requests must be made in writing.
6.1 Cancellation
- For a guesthouse reservation:
The client will be charged 50% of the total price if they cancel 1 day before arrival.
The client may cancel free of charge up to 3 days before arrival.
- For a gîte reservation:
The client will be charged 50% of the total price if they cancel within 7 days of arrival.
The client may cancel free of charge up to 14 days before arrival.
6.2 Shortened Stay
Any stay that has commenced is payable in full.
6.3 Modification
Any modification is subject to the establishment's express acceptance and may result in a price adjustment.

Article 7 – Cancellation by the Establishment
In the event of an exceptional cancellation by the establishment, all sums paid will be fully refunded, and no additional compensation may be claimed.
The establishment may offer an alternative solution without the client being obligated to accept it.

Article 8 – Arrival and Departure
Arrival: between 4:00 PM and 8:00 PM
Departure: no later than 12:00 PM
In the event of an unannounced late arrival, the reservation may be considered canceled at the client's expense.

Article 9 – Use of Premises
The client agrees to:
- respect the peace and quiet of the premises
- behave respectfully towards other occupants and staff
- leave the premises in good condition
Any behavior contrary to public decency, public order, or safety regulations will result in expulsion without refund.

Article 10 – Capacity and Occupancy
The number of people is strictly limited to that indicated at the time of booking.
Any excess may result in refusal of access or immediate termination of the stay without refund.

Article 11 – Use of the Gym
Access to the gym is reserved exclusively for guests of the establishment and is subject to the hours defined by the establishment.
By using the gym, the client acknowledges:
- having read the posted safety and usage instructions,
- being fit to engage in physical activity,
- using the equipment under their sole responsibility and at their own risk.
The establishment declines all responsibility in the event of an accident, injury, or illness, improper use of equipment, or failure to comply with posted instructions.
The customer remains fully responsible for any material or personal injury caused by themselves or to the equipment provided.

Article 12 - Use of the swimming pool
Access to the swimming pool is strictly reserved for establishment customers, during the current opening hours.
As the swimming pool is unsupervised, its use is the sole responsibility of the users.
By accessing the swimming pool, the customer acknowledges:
- having read the posted hygiene and safety rules,
- using the facilities at their own risk,
- being responsible for the supervision of any accompanying minors, who remain under their exclusive care at all times.
The establishment declines all responsibility in the event of an accident, drowning, or injury, failure to comply with safety instructions, or improper use of the facilities.
For hygiene and safety reasons, the establishment reserves the right to restrict access to the swimming pool without prior notice.

Article 13 – Prohibitions
- Smoking (including vaping) is strictly prohibited indoors. Smoking is permitted outdoors provided cigarette butts are not discarded on the ground.
- Pets are not allowed unless prior written consent has been obtained.
Any violation may result in a cleaning fee or expulsion.

Article 14 – Liability
The establishment cannot be held liable:
- in the event of theft, loss, or damage to personal belongings
- in the event of interruption or disruption of the stay due to force majeure (inclement weather, network outages, etc.)
- in the event of improper use of the facilities
The client is responsible for any damage caused by themselves or their companions.
Liability insurance is strongly recommended.

Article 15 – Force Majeure
The establishment cannot be held liable in the event of an unforeseeable, irresistible, and external event preventing the performance of the contract.

Article 16 – Personal Data
The information collected is necessary for managing reservations and is processed in accordance with applicable regulations (GDPR).
The client has the right to access, rectify, and delete their personal data.

Article 17 – Environmental Charter and Regenerative Tourism
Within the framework of these General Terms and Conditions of Sale, Clos Ceres commits to implementing the principles defined in its environmental charter, aimed at promoting sustainable and regenerative tourism.
This commitment constitutes an obligation of means, not of result. As such, the establishment strives in particular to:
limit water and energy consumption, prioritize local products and short supply chains, reduce and recycle waste, and preserve natural resources and biodiversity.
The client acknowledges that the implementation of these commitments may lead to certain adjustments in the services offered (particularly regarding services, equipment, or comfort), without this being considered a breach of contract.
Consequently, no claim, request for compensation, or refund may be based on the application of this environmental approach.


Article 18 – Prohibition of Illegal Substances
The client agrees to comply with all applicable French laws during their stay.
It is strictly forbidden to bring in, possess, consume, or distribute substances classified as narcotics under French regulations within the establishment.
In the event of a breach of this prohibition, the owner reserves the right to terminate the client's stay immediately, without refund, and to report the matter to the appropriate authorities.
The client is solely responsible for the legal consequences of their actions. The owner cannot be held liable for any illegal behavior on the part of the client.


Article 19 – Disputes and Applicable Law
These Terms and Conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought first. Failing that, jurisdiction is granted to the territorially competent courts.
